Parliamentary working group was held to discuss the draft law on archival affairs

As a reminder, during the previous day’s meeting the working group adopted an amendment to the Law on the Rights of the Child, specifically to Article 34, paragraph 3, by adding after the word “violence” the phrase: “promoting non-traditional sexual orientation and pedophilia”.

Today, members of the working group in Parliament unanimously voted in favor of the following amendments:

1. Introduction of administrative liability for the “propaganda of non-traditional sexual orientation and pedophilia” under Article 456-2 of the Code of Administrative Offenses of the Republic of Kazakhstan. For the first offense — a fine of 20 MCI; for a repeated offense — 40 MCI or administrative arrest for up to 10 days.

2. Amendments to the Law on the Rights of the Child:

• Article 39, paragraph 1: after the word “pornography” the term “propaganda” is added.
• Article 39, paragraph 1, part 3 is supplemented with the following definition:
  “Propaganda is understood as the dissemination of information about non-traditional sexual orientation and adherence to it, carried out publicly or through mass media, telecommunications networks, or online platforms, including deliberately distorted information intended for an indefinite audience for the purpose of forming a positive image”.

3. Similar amendments are proposed to be introduced into the following laws:

• the Law on Advertising
• the Law on Communications
• the Law on Culture
• the Law on Education
• the Law on the Protection of Children from Harmful Information
• the Law on Cinematography
• the Law on Online Platforms
• the Law on Mass Media

The Ministry of Internal Affairs, the Ministry of Culture and Information, the Ministry of Justice, and the Government did not object to these provisions.
